Vanderbilt Bankruptcy: Primary-Source Register

The documents behind the research—and what each does and does not establish.

Research cutoff: October 17, 2026. The October 16 liquidation plan remains proposed. This register is a research aid, not a substitute for later docket entries, legal advice, or attorney review.

Judicial decisions and orders

April 27 memorandum decision (Docket 491)

Type: Court ruling. The bankruptcy court analyzed the disputed affiliate settlement and distinguished estate-owned causes of action from independent direct claims. Its discussion does not establish the viability of any particular individual's claim or resolve subsequent appeals. Read the court's memorandum decision.

June 29 bar-date order (Docket 773)

Type: Court order. The general proof-of-claim deadline did not require holders of Direct Talc Claims to file proofs of claim under that order. The order does not rule out future deadlines or requirements. Review the original filed order through the official case administrator and our claims-deadline explanation.

Party filings and contested positions

March 10 committee motion to dismiss (Docket 147)

Type: Party motion, not a court finding. Documents the creditors' committee's early challenge to the bankruptcy. Compare with its later negotiations and the committee chronology.

September 4 insurer objection (Docket 916)

Type: Party objection, not a court finding. Insurers contested aspects of the earlier plan, including proposed insurance-related treatment and injunction provisions. The objection alone does not establish the final treatment of coverage or claims. Read the September 4 objection.

October 6 U.S. Trustee objection (Docket 1012)

Type: Federal oversight objection, not a ruling. The United States Trustee filed an objection to the disclosure statement and related plan provisions before the October 16 revisions. Whether the amended documents addressed those concerns requires a side-by-side review. Read the October 6 filing.

October 16 joint amended plan and related filings (Dockets 1037–1042)

Type: Proposed plan and supporting filings. The committee's support letter, plan, disclosure statement, supplement and redlines provide the next comparison baseline. Unresolved: the October redlines have not been independently compared clause by clause in this research release. The filings alone do not establish confirmed trust funding, payment percentages, final releases, or operating claim procedures. Find these filings at Verita.

Historical industrial talc record

Armstrong Mold memorandum, May 4, 1992

Type: Historical company document. Records removal of bags of Mouldene at a named East Syracuse facility. It supports a product-place-date connection, not an inference that a particular person was exposed or that every talc grade was asbestos-containing. Read the original memorandum.

Talcville Mine No. 3 state mine record

Type: State regulatory location record. Identifies a mine; it is not a product-specific exposure determination. View the New York DEC mine record. See the historical talc evidence guide.

October 16 plan: established facts and unresolved issues

The October 16 filings are a documentary checkpoint, not a confirmation order. The following research matrix separates filing facts from matters that require examination of the operative language.

IssueEstablished research pointWhat remains unresolved
Plan statusAn amended liquidation plan was filed October 16 (Docket 1038).Any later court order approving disclosure, confirming the plan, or changing the schedule.
Committee positionThe committee filed a support letter October 16 (Docket 1037), following earlier opposition and negotiations.Precisely what concessions and conditions explain the negotiated position.
Trust and fundingA liquidation trust is proposed; the filing itself does not make it operational.Final trust assets, insurance rights, expenses, distribution procedures, and effective-date conditions.
Direct talc claimantsThe June 29 general bar-date order exempted Direct Talc Claims from its proof-of-claim deadline.Whether later operative documents create different notice, submission, or trust deadlines.
Releases and third partiesThe April 27 decision discussed the distinction between estate-owned and independent direct claims.Exact October 16 proposed release language, objections, any approval, and effect on specific claims.
InsurersInsurers objected September 4 to aspects of an earlier proposal.Whether October amendments resolve, narrow, or leave those disputes for the court.
U.S. TrusteeThe United States Trustee filed an objection October 6 (Docket 1012).Which concerns, if any, were addressed in the October 16 revisions and whether objections remain pending.

Why the distinctions matter: allegations, proposed plan terms, court rulings, and effective trust procedures have different legal significance.

Important provisions in the October 16 filings

The October 16 plan (Docket 1038), disclosure statement (1039), supplement (1040), and redlines (1041) address issues that could affect future talc claims. The table identifies key subjects; it does not represent a final judicial determination of those provisions.

Review trackSpecific provisions to compareWhy it matters
Trust propertyInitial funding, insurance assets, assignment terms, reserves, and costsGross proposed funding is not the same as money ultimately available for claimant distributions.
Claim treatmentDefinitions of Direct Talc Claims, classification, eligibility, proof, and future submission requirementsA past exemption from the general bar date does not settle future trust procedures.
ReleasesReleased parties, released claims, injunction scope, consent and opt-out language if anyScope may affect legal rights and must be read against the April ruling and subsequent orders.
InsuranceCoverage assignments, insurer defenses, settlements, cooperation, and retained jurisdictionAn insurance objection is not itself a judicial resolution or proof of available proceeds.
ConditionsConfirmation requirements, effective-date conditions, appeals, and implementation milestonesA proposed trust is not an operating compensation mechanism until the necessary legal steps occur.

Document status: The October 16 amendments have not been fully compared provision by provision with the earlier proposal. No particular change to claimant rights or payments is asserted here without verification.

October 19 hearing: status and next document

As of this October 17 research cutoff, the disclosure-statement hearing was scheduled for October 19, 2026, at 11 a.m. Eastern. It is not a plan-confirmation hearing. The outcome will depend on the court’s subsequent orders. The official docket will provide any revised disclosure statement, voting or solicitation instructions, and future confirmation dates.

Questions the bankruptcy proceedings have not yet resolved

The operative October 16 trust distribution procedures, the exact effect of any revised releases, insurer coverage disputes, and any later direct-talc-claim deadlines remain subjects for documentary review. Proposed plan provisions must be distinguished from confirmed terms and subsequent orders.

Research current through October 17, 2026. Court filings and deadlines may change.
