Minerals Technologies Inc. reported 1,051 pending lawsuits involving talc products previously sold by its former subsidiary Barretts Minerals as of October 4, 2026. At the same time, a proposed $450 million trust intended to address current and future talc-related claims remains unconfirmed amid a dispute over the procedure for evaluating scientific allegations.
The company's October 2026 quarterly filing also reports that the U.S. Court of Appeals for the Fifth Circuit has scheduled December 1 oral argument on a creditors' committee petition challenging the district court's handling of a proposed scientific determination. The hearing concerns procedure; it will not itself be a trial establishing that a particular talc product contained asbestos or caused mesothelioma.
How many talc cases are pending?
In its Form 10-Q for the quarter ended October 4, Minerals Technologies reported 986 pending cases at the beginning of the quarter, 97 newly filed cases, and 32 cases dismissed, settled, or otherwise resolved, leaving 1,051 pending cases at quarter-end. These are company-reported litigation figures, not findings that individual claims have been proved.
Minerals Technologies disputes the allegations and maintains that the talc products sold by BMI Oldco, formerly Barretts Minerals, were safe.
What is the proposed $450 million trust?
BMI Oldco and Barretts Ventures Texas LLC filed for Chapter 11 protection in October 2023. Minerals Technologies itself was not among the Chapter 11 debtors.
On June 29, 2026, Minerals Technologies filed a proposed reorganization plan providing, among other things, for $450 million in funding for a talc personal-injury trust. The plan also proposes a channeling injunction under Section 524(g) of the Bankruptcy Code to address qualifying current and future claims through a trust mechanism.
The plan has not been confirmed, and the proposed trust is not an operational compensation program. The filing of a plan does not establish that a claimant is eligible for payment or that any payment will be made.
Why are the proceedings delayed?
In May 2025, the bankruptcy court recommended that the federal district court determine whether talc sold by BMI Oldco contained asbestos in sufficient quantity and form to cause mesothelioma or other asbestos-related diseases. The district court adopted the recommendation in June 2026.
The Official Committee of Unsecured Creditors petitioned the Fifth Circuit for a writ of mandamus challenging that procedural approach. According to the October SEC filing, the appellate court stayed the district-court proceedings on October 2 and agreed to hear argument on December 1. The bankruptcy proceedings also remain abated.
The committee's challenge concerns the procedure for addressing the scientific dispute. It does not, by itself, resolve the merits of the underlying product-liability allegations.
Why does this matter to people diagnosed with mesothelioma?
Mesothelioma can develop decades after asbestos exposure. When exposure is alleged to involve talc products, identifying the product, historical manufacturer, supplier, and dates of use may be essential to evaluating a claim. The existence of a proposed bankruptcy trust does not replace that factual investigation.
For people following the Barretts proceedings, the distinction between pending lawsuits, proposed trust funding, and approved compensation procedures is especially important. At present, the $450 million figure describes a proposal—not money available through an established trust claims process.
What happens next?
The Fifth Circuit's official calendar lists oral argument for December 1, 2026, at 3:00 p.m. Central Time, in New Orleans, Case No. 26-20568. The appellate court's subsequent action may affect how the underlying scientific issue is addressed and, in turn, the bankruptcy's progress. No outcome should be presumed.
